How is negligence determined?
Whenever a person has a duty to act carefully and fails to do so is considered to be acting negligently especially if the action has caused injury or death. Generally, we all have a duty to act in such a manner not to injure those around us. For instance a person driving at night while wearing sunglasses is negligent because other reasonable drivers would know that doing so increases the chances of incurring a motor vehicle collision. In most types of wrongful death cases, a person must be found negligent to be held legally responsible for another person’s injuries or death. If a person has behaved negligently and caused harm to you or your love ones, you can recover compensation for your or your loved one’s suffering.
