How is negligence determined?

Whenever a person has a duty to act carefully and fails to do so is considered to be acting negligently especially if the action has caused injury or death. Generally, we all have a duty to act in such a manner not to injure those around us. For instance a person driving at night while wearing sunglasses is negligent because other reasonable drivers would know that doing so increases the chances of incurring a motor vehicle collision.
